How we collect, use, and protect personal data, for Blendwave customers and for the people who interact with their AI agent.

This Privacy Policy describes how Blendwave LC ("Blendwave," "we," "us," or "our") collects, uses, and shares personal information when you visit https://blendwave.ai (the "Site") or use the Blendwave service (the "Service").
If you do not agree with this policy, please do not use the Site or the Service.
1. Who we are and the two roles we play
Blendwave LC is a Maryland limited liability company.
We process personal information in two distinct roles:
- As a controller, for information about our own account holders, Site visitors, and prospective customers. This policy governs that processing.
- As a processor (service provider), for information contained in communications between our business customers and *their* customers (for example, messages, call recordings, and contact details handled through the Service). We process that information on our customers’ behalf and under their instructions. If you have communicated with a business that uses Blendwave, that business is the controller of your information. Please direct privacy requests to them. We will assist our customers in responding to such requests.
2. Information we collect
Information you provide to us:
- Account information: name, business name, email address, phone number, password.
- Billing information: processed by our payment provider (Stripe). We do not store full card numbers.
- Communications with us: support requests, emails, and feedback.
Information processed through the Service (on behalf of our customers):
- Conversation content across connected channels (voice, SMS, WhatsApp, Instagram, email, iMessage, and web chat), including message text, call audio, recordings, and transcripts.
- Contact details of the people communicating with our customers (such as names, phone numbers, and email addresses).
- Metadata about conversations (timestamps, channel, delivery status).
Information collected automatically:
- Usage data: pages visited, features used, and interactions with the Site and Service.
- Device and log data: IP address, browser type, operating system, and error logs.
- Analytics: we use privacy-respecting analytics configured to operate without advertising cookies. We do not use third-party advertising trackers on the Site.
3. How we use information
We use personal information to:
- Provide, operate, maintain, and improve the Site and the Service;
- Process conversations through our AI systems in order to generate responses, summaries, and routing on our customers’ behalf;
- Transcribe and process voice calls to deliver the Service;
- Set up and manage accounts, process payments, and send transactional messages;
- Provide customer support;
- Monitor for security, prevent fraud and abuse, and enforce our terms;
- Comply with legal obligations.
AI processing. The Service uses artificial intelligence models operated by our AI service providers to process conversation content. Under our agreements with these providers, conversation data submitted through their APIs is used to provide the Service and is not used by them to train their generally available models. We do not sell conversation data.
4. How we share information
We share personal information only with:
- Subprocessors and service providers that help us deliver the Service (hosting, databases, telephony and messaging carriers, AI model providers, speech processing, payments, email delivery, analytics, error monitoring, and security). A current list is maintained at https://blendwave.ai/subprocessors. Each is bound by contractual obligations to protect the information and use it only to provide services to us.
- Our business customers, conversation data belongs to the customer whose channels it flows through, and is visible to them in their inbox.
- Legal and safety recipients, where required by law, subpoena, or to protect rights, safety, or the integrity of the Service.
- A successor entity in connection with a merger, acquisition, or sale of assets, subject to this policy.
We do not sell personal information, and we do not share personal information for cross-context behavioral advertising.
5. Mobile information and text messaging
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.
Information shared with subprocessors strictly to enable delivery of messages (such as our telephony carrier) is excluded from the above only to the extent necessary to deliver the Service, and never for marketing.

6. Call recording and transcription
Calls handled through the Service may be recorded and/or transcribed to provide the Service. Our business customers are responsible for providing any legally required notices to, and obtaining any legally required consents from, participants on their calls. The Service provides configurable call announcements to support compliance with call-recording and consent laws, including all-party-consent jurisdictions.
7. Data retention
We retain personal information for as long as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. Conversation data processed on behalf of our customers is retained according to the customer’s configuration and our agreement with them, and is deleted or returned upon verified request or account termination, subject to legal retention requirements and backup cycles.
8. Security
We use administrative, technical, and physical safeguards appropriate to the nature of the information, including encryption in transit, encrypted credential storage, access controls, and logging. An overview is available at https://blendwave.ai/security. No system is perfectly secure, and we cannot guarantee absolute security.
9. Your rights and choices
Depending on where you live, you may have rights to:
- Access the personal information we hold about you;
- Correct inaccurate information;
- Delete your information;
- Receive a portable copy of your information;
- Object to or restrict certain processing;
- Opt out of the sale or sharing of personal information (we do not sell or share as those terms are defined under applicable US state laws);
- Not be discriminated against for exercising these rights.
To exercise any of these rights, email privacy@blendwave.ai. We will verify your request and respond within the timeframe required by applicable law. You may also authorize an agent to act on your behalf. If we deny your request, you may appeal by replying to our decision.
If your information was processed because you communicated with a business that uses Blendwave, we will refer your request to that business and assist them in responding, as we act as their processor.
Residents of the EEA, UK, or Switzerland may also lodge a complaint with their local supervisory authority.
10. International transfers
We are based in the United States, and information is processed in the United States. Where we receive personal information from the EEA, UK, or Switzerland, we rely on appropriate safeguards recognized under applicable law, such as the EU Standard Contractual Clauses and, where applicable, participation by our subprocessors in the EU-U.S. Data Privacy Framework.
11. Children
The Site and the Service are intended for business use and are not directed to anyone under 18. We do not knowingly collect personal information from children under 18. If you believe a child has provided us personal information, contact us at privacy@blendwave.ai and we will delete it.
12. Changes to this policy
We may update this policy from time to time. We will post the updated version on this page with a revised "Last updated" date, and for material changes we will provide additional notice (such as email to account holders). Continued use of the Service after changes take effect constitutes acceptance.
